When we use the word “share” anywhere in this Privacy Policy we mean disclose or transfer to any third party for any of the purposes in this section unless stated otherwise. You have the right to opt-out of our sale of your personal data or our sharing of your personal data for cross-contextual behavioral advertising or targeted advertising.

Categories of Third Parties with Whom We Share Your Personal Data

We share your personal data with the categories of parties listed in this section. Depending on state laws that may be applicable to you, when we share your personal data with these third parties, it may constitute a "sale" of your personal data (for example, when we share your personal data in exchange for money or other valuable consideration).

  • Our Vendors. These parties help us provide the Services or perform business functions on our behalf, including hosting, technology, and communication providers; security and fraud prevention consultants; support and customer service vendors; product fulfillment and delivery providers; our attorneys, advisors, and accountants; and payment processors

    • Our payment processing partner Stripe, Inc. ("Stripe") collects your voluntarily-provided payment card information necessary to process your payment; please see Stripe's privacy policy at https://stripe.com/privacy for information on its use and storage of your personal data

  • Advertising Providers. These parties help us market our services and provide you with information regarding third party products and services that may be of interest to you, including ad networks, data brokers, marketing providers, and cooperative databases

  • Analytics Providers. These parties provide analytics on web traffic or usage of the Services, including companies that track how users found or were referred to the Services and companies that track how users interact with the Services

  • Parties You Authorize, Access, or Authenticate, including third parties you access through the services, social media services, and other users

  • Parties for Legal Purposes. We may share any personal data that we collect with third parties in conjunction with any of the activities set forth under "Meeting Legal Requirements, Enforcing Legal Terms, and Making Certain Business Transfers” in the above section called Our Commercial or Business Purposes for Collecting and Sharing Personal Data. All of your personal data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business or assets (in whole or in part).

Retention of Personal Data

We retain personal data about you for as long as necessary for the purposes described in the above section called Our Commercial or Business Purposes for Collecting and Sharing Personal Data (such as providing the Services to you). This may include keeping your personal data after you have stopped using our Services; for example, we may retain your personal data to advertise to you (unless you opt-out), comply with our legal obligations, or resolve disputes or collect fees owed.

APPLICABILITY OF THIS PRIVACY POLICY

This Privacy Policy covers how we treat personal data that we gather from you or third parties related to our Services or your other interactions with us. This Privacy Policy does not cover the practices of companies we don't own or control or people we don't manage.

Sources of Personal Data

We collect personal data about you from the following categories of sources:

  • Directly from you, such as, when you create an account or use our interactive tools and Services; when you voluntarily provide information in free-form text boxes through the Services or through responses to surveys or questionnaires; or when you send us an email or otherwise contact us

  • Indirectly from you, including, through cookies; if you use a location-enabled browser, we may receive information about your location; if you download and install certain applications and software we make available, we may receive and collect information transmitted from your computing device for the purpose of providing you the relevant Services, such as information regarding when you are logged on and available to receive updates or alert notices

  • From third parties, for example, we may use analytics providers to analyze how you interact and engage with the Services; third parties may help us provide you with customer support; we receive information about you from some of our vendors who assist us with marketing or promotional services related to how you interact with our Services, applications, products, advertisements, or communications

Exclusions from Personal Data

Personal data does not include information publicly available from government records.

Personal data does not include information that is not personal, like anonymous, deidentified, or aggregated data, even if it comes from personal data. We may create aggregated, deidentified or anonymized data from the personal data we collect, including by removing information that makes the data personally identifiable to a particular individual. We may use such aggregated, deidentified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.

Personal Data of Children

As noted in the Terms of Use, we do not knowingly collect, process, or share personal data about children under 18 years of age; if you are a child under the age of 18, please do not attempt to register for or otherwise use the Services or send us any personal data. If we learn we have collected personal data from a child under 16 years of age, we will delete that data as quickly as possible. If you believe that a child under 16 years of age may have provided personal data to us, please contact us at caninecare@myollie.com.

To our knowledge, we do not sell or share for cross-contextual behavioral advertising or targeted advertising purposes the personal data of children under the age of 16.

Employment Data

This Privacy Policy does not apply to personal data that we collect in connection with your employment or potential employment at Ollie. Employees and employment applicants should review our Employment Data Privacy Policy.

Third-Party Services

This Privacy Policy does not apply to any third-party websites or applications that you may be able to access through the Services. We do not have control over the privacy practices or the content of these third-party websites or applications. As such, we are not responsible for the privacy practices employed by or content contained on websites or applications linked to or accessible from our Services. You should check the applicable third-party privacy policy and terms of service when visiting any other websites or applications, and before providing any personal data to them.

YOUR PRIVACY RIGHTS AND CHOICES

Notice of Your Personal Data Rights

Subject to exemptions and restrictions provided by applicable law, you have the right to:

  1. Request that we disclose certain information to you about our collection and use of your personal data (collectively, the following constitute the "right to know"):

    • Whether or not we are processing your personal data

    • The categories of personal data we collected about you

    • The categories of sources for the personal data we collected about you

    • Our business purposes for collecting or sharing that personal data

  8. Limit the use or disclosure of your sensitive personal data to just those actions necessary to perform specific purposes outlined by law (the “right to limit use of sensitive information”)

    • We do not use or disclose sensitive personal data (for example, your Ollie account username and password) for purposes other than purposes that would continue to be allowable after the receipt of a limitation request, including to provide Services and ensure the security of your account

How to Exercise Your Personal Data Rights

To exercise the rights described above, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected personal data, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a "Valid Request." We may ask for information to verify your identity, such as name, email, phone number, and address. For a request to opt out of sale or opt out of behavioral advertising, we do not require a verifiable request. We will only use personal data provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request promptly within the timeframes required by applicable privacy law (usually between 15 to 45 days depending on the type of Valid Request, with the right for us to extend the response time as necessary). We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

You may also authorize an agent (an "Authorized Agent") to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

In some instances, we may not be able to honor your request. For example, we may not honor your request if we cannot verify your identity or if we cannot verify that you have the authority to make a request on behalf of another individual. Additionally, we may not honor your request where not required or an exception applies under applicable privacy laws. For example, we may deny a deletion request if the information is necessary for us to provide the Services to you or comply with our legal obligations and compliance policies. We may deny a right to know request made more than twice in a 12-month period or for information collected and disclosed more than 12 months ago. We will advise you in our response if we are not able to honor your request.

You have the right to appeal our decision to not honor your request or our refusal to take action on a request within a reasonable period of time by contacting us at the email or toll-free number listed above and clearly stating that the purpose of the contact is an “appeal of privacy rights.” Within 45 days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.

OUR USE OF COOKIES

Our Use of Cookies and other Tracking Technology

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, "Cookies") to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s).

We use the following types of Cookies:

  • Essential Cookies. Essential Cookies are required for providing you with features or services that you have requested. For example, certain Cookies enable you to log into secure areas of our Services. Disabling these Cookies may make certain features and services unavailable.

  • Functional Cookies. Functional Cookies are used to record your choices and settings regarding our Services, maintain your preferences over time and recognize you when you return to our Services. These Cookies help us to personalize our content for you, greet you by name and remember your preferences (for example, your choice of language or region).

  • Performance/Analytical Cookies. Performance/Analytical Cookies allow us to understand how visitors use our Services. They do this by collecting information such as log-on activity, date, time and length of visits, number of visitors to the Services, search terms used, what pages visitors view on the Services, the number and type of views, clicks and downloads, and the people, features, content (including advertisements) and links visitors interact with when using the Services. Performance/Analytical Cookies also help us improve our Services by measuring any errors that occur and allowing us to test different content, features and functionality. Performance/Analytical Cookies also help us measure the performance of our advertising campaigns in order to help us improve our campaigns and the Services' content for those who engage with our advertising. We allow third parties to place and collect Performance/Analytical Cookies via our Services.

  • Retargeting/Advertising Cookies. Retargeting/Advertising Cookies collect data about your online activity and identify your interests so that we and third parties can provide advertising that may be relevant to you. We allow third parties to place and collect Retargeting/Advertising Cookies via our Services. For more information about this, please see the section below called Information about Targeted and Cross-Contextual Behavioral Advertisements.

  • Chatbots. We may use chatbots operated by third parties to efficiently assist with resolving customer issues and to improve our Services. By using a chatbot offered through the Services, you hereby consent to the use of such chatbot and to the collection of any information that you provide to such chatbots, including any personal data submitted.

Do Not Track

“Do Not Track” is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. Ollie’s Services are not currently configured to respond to Do Not Track signals or other mechanisms that provide users the ability to exercise choice regarding the collection of personal data about a user’s online activities over time and across third party websites or online services.

Opt-Out Preference Signal

An opt-out preference signal is a configuration that you set on your device or browser that signals that you request to opt-out of the sale of personal data or the sharing of personal data for cross-contextual behavioral advertising or targeted advertising. If the signal is in a format commonly used and recognized by businesses (e.g., HTTP header field or JavaScript object), when we receive the signal, we treat the signal as a request to opt out of such sale or sharing made by the browser or device sending the signal and any consumer profile associated with such browser or device if known to us.

Disable or Delete Cookies

You can decide whether or not to accept certain Cookies through your internet browser's settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways. You can also delete all Cookies that are already on your device. If you do this, however, you may have to manually adjust some preferences every time you visit our website and some of the Services and functionalities may not work.

Information about Targeted and Cross-Contextual Behavioral Advertisements

We may serve advertisements through the Services. We may also allow third-party ad networks, including third-party ad servers, ad agencies, ad technology vendors, research firms and social media networks to track your activity through the Services and serve advertisements through the Services or based on information collected about your interactions with the Services. These advertisements may be targeted to users who fit certain general profile categories or display certain preferences or behaviors. Information for targeted ads (including personal data) may be provided by you to us, or derived from the usage patterns of particular users on the Services and/or services of third parties. Such information may be gathered through tracking users' activities across time and unaffiliated properties, including when you leave the Services. To accomplish this, we, our vendors or third parties may deliver Cookies, including a file (known as a "web beacon") from an ad network to you through the Services. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted ads to you when you visit other websites.
